Important facts to know about this auction before you register and bid.

  1. This is a Lender in possession public auction to sell the assets of the former Max Hughes Trucking Company in Troy, Alabama.
  2. The trucking company closed in the last few months.  All of the trucks were used in daily operation until the company was closed.
  3. Pearce & Associates/MarkNet Alliance, a national auction firm was chosen by the lender and approved by USDA to conduct this auction liquidation.  Pearce is a well known liquidation firm with over 35 years experience in the auction and appraisal business.  
  4. Online bidding has opened and will end on January 20th.  
  5. Pearce will conduct an OPEN HOUSE for the public to come inspect the assets in person.  Check back on this site or look for email notifications as to the dates we will have available.  We encourage ALL prospective bidders to come inspect in person.
  6. Successful buyers will be required to submit payment by Bank Wire, Certified Funds or Cashiers Check to Pearce & Associates within 3 business days of the auctions ending (January 23 @ 5:00pm central).
  7. ALL assets must be removed off of the property no later than January 31st as the property owner will take possession of the property.  If you are unable to pick up your purchase by January 31st, we will provide a local moving and storage company for you to contact for help.  Please make these arrangement prior to the end of the month so that they can put you on schedule.  You, the purchaser are responsible for this expense.
  8. Some of the trucks may have dead or low batteries and may require that you charge the "TriPac" and then jumpstart to drive off or transport.  Please make sure that you are prepared when you come pick up your purchase.  We will have some help onsite but we encourage you to handle your own starting with your equipment.
  9. The provided bidding catalog will include the following details of each truck:  Year, Make, Model, Miles, Multiple Photos (click on featured photo and additional photos will show up), A video of the truck running at idle, a basic description (if known by the auction company, it will also include any mechanical issues that are obvious). NOTE:  The auction company, nor the lender makes any representation or guarantees descriptions or mechanical conditions.  Again, we encourage a personal inspection.  We do guarantee free and clear title to every vehicle offered in this auction.
  10. BIDDING - This auction features "EXTEND ONE, EXTEND ALL"!  The feature means that during he final 5 minutes of the auction, any vehicle that receives a bid will reset the entire bidding catalog clock at 5 minutes.  No truck will end until all of the trucks have ceased to get bids.  This features allows every bidder an opportunity to bid on one or multiple trucks without any of the trucks ending.  The auction will continue until all bids have been placed.  
  11. Parts/Shop Equipment and other assets are being sold in a separate catalog.  They are also located on our website for your participation.

OPEN HOUSE INSPECTIONS:   Wednesday, January 15, 2025 and Thursday, January 16, 2025 from 9am to 3pm Central Time. 

Payment:  ALL items must be paid for by wire transfer within 3 calendar days of the auction's end - to be received no later than January 23, 2025 at 5pm Central time.

Pick-up/Removal: - ALL trucks must be removed from property no later than Friday, January 31, 2025 at 3pm Central time.

Auction Terms: Please read the terms carefully as they are a legal binding contract between you and Pearce & Associates Auctioneers.All disputes will be settled in Shelby County, Alabama.We encourage you to inspect the items in person.If purchases are not settled within 3 business days of the close of the auction,it is in default. Upon default the bidder will be black listed on Pearce &Associates Auctioneers auctions as well as MarkNet auctions andwill be charged for the merchandise. The seller understands that any claims from descriptions, condition, miles, etc are between the owner (seller) and the purchaser. The auctioneer does not guarantee year, make, model, miles, hours, running condition, physical condition of any item in our auctions. You, the purchaser are responsible for inspecting the assets in person and making your own determination as to the condition of the item you are bidding on. The only exemption is non Alabama residents which require an Alabama drive out form to be executed by the purchaser and licensed Alabama Automobile Dealers. Pearce & Associates shall require a copy of the buyers dealer license.Pearce & Associates shall handle title work and provide a copy to the purchaser within 14 business days of payment.  Dealer titles and out of state buyers shall be mailed (certified) the actual title within 14 business days from final payment.The State of Alabama (auction company residence) does not title vehicles 35 years old and older.  Vehicles 35 years and older will come with an Alabama Bill of Sale only and a letter from the State of Alabama stating our title laws exempting these vehicles.  Boat trailers are also exempt from titles in Alabama.REMOVAL: All trucks must be removed from the property Friday January 31, 2025 by 3pm - NO EXCEPTIONS! . Bidding info- When you bid your max the current bid price doesn't automatically go toyour max bid. Someone else has to bid to increase the current price and the computer will automatically bid up to your max in the increments specified.This auction features an auto extend called "Extend One, Extend All". Any vehicle that receives a bid in the last 5 minutes will reset the clock at 5 minutes on ALL vehicles in this auction. The auction will continue until all bids have ceased. This bid extension allows EVERY buyer the opportunity to bid on single vehicles, multiple vehicles or the entire catalog of vehicles without any individual item ending while the auction is continuing.  The auction does not end until all bids have ceased.Pearce & Associates Auctioneers have put forth every effort to make accurate description of the items.
